The ruling was a victory for the Watershed Institute, an environmental nonprofit that challenged the DEP’s permit in court. Its executive director, Jim Waltman, urged DEP to require a new application that uses the new flood rule for the permit in question. He said there are also some “deficiencies” with a separate freshwater wetlands permit issued for the project.
“Given the enormity of the proposal, and the potential for serious flooding and water quality impacts, the latest precipitation standards should be applied,” Waltman wrote in an email to NJ Spotlight News.
